Redfish Rentals and Beach Services
RENTAL OPERATIONS ASSUMPTION OF RISK, WAIVER OF CLAIMS, AND RELEASE OF LIABILITY AGREEMENT
Please read and be certain you understand the implications of signing. Express assumption of all risks associated with participating in the activities and use of rental equipment of Redfish Rentals and Beach Services Board/Bike and related activities. All of these activities are NOT WITHOUT RISK. You are engaging in this activity at your own risk and agree to this Assumption of Risk, Waiver of Claims, and Release of Liability as to Redfish Rentals and Beach Services and all parent and/or affiliated entities associated with the YOLO Brands (together “YOLO”)
Statement and Acknowledgement of Risks:
I affirm and acknowledge that I am aware of the inherent hazards and risks associated with Redfish Rentals ("Redfish Rentals and Beach Services") and related land/water sport activities to which I am about to engage, including but not limited to:
1. Changing water flow, tides, currents, wave action, ship’s wakes, inclement weather, lightning; variances and extremes of wind, weather and temperature, the presence of insects and marine life forms, collision, capsizing, or other hazard that may result in wetness, submersion in water, injury, exposure to the elements, equipment failure or operator error, drowning, traffic, road hazards, nature, wild animals, insects, stinging or biting sea life.
2. I specifically acknowledge that I understand and agree to abide by the Yolo Board operational instructions at all times and that I have been trained in the safe use of REDFISH RENTALS equipment to my complete satisfaction. I verify that I am physically/mentally able to participate in the water sport activities in which I am about to engage and AM NOT AND WILL NOT BE UNDER THE INFLUENCE OF ALCOHOL OR ANY DRUGS. I assume full responsibility for myself and any minor children in my care, for any bodily injury, incident, illness, death, loss of personal property and expenses thereof as a result of any incident which may occur while I / we participate in this activity. I voluntarily elect to participate in this activity understanding the risks and I freely and expressly ASSUME and accept ANY AND ALL RISKS, INCLUDING ANY RISKS NOT SPECIFICALLY IDENTIFIED, INJURY OR DEATH. I specifically waive any defense insofar as this contract is concerned that may arise as a result of any state or local law and/or regulation or policy that may impact its enforceability.
Terms, Conditions of Use, and Authorization:
All equipment (which may include SUP boards, bicycles, beach play equipment or any other equipment) will be inspected by you for damage before and after the rental period. Renter agrees that he/she has rented the items described above and has examined them and determined them to be in good condition and will return in as good condition with the exception of ordinary wear and tear to be expected. Renter will return equipment at once if the item is not functioning normally.
Renter will pay promptly all costs resulting from damages to equipment. Renter agrees not to use equipment for other than its intended purpose or to act recklessly while using equipment or in a way that endangers others. If renter fails to abide by the terms of this contract, REDFISH RENTALS may repossess without notice to renter, and REDFSIH RENTALS is hereby released from all claims arising therefrom. Should the equipment be lost, stolen, or damaged during the rental period, the renter will be financially responsible for repair or replacement costs as determined by REDFISH RENTALS in its sole and unfettered discretion. REDFISH RENTALS is not responsible for accidents, property damage, or personal injury caused directly or indirectly in the use of these rented items. Early return of rental items does not qualify for reduction of fees. I either have appropriate insurance or, in its absence, agree to pay all costs of rescue and/or medical services that may be incurred on my/our behalf. I agree that any film or photographs of me/us as participants become your property and may be used for promotional or commercial purposes with NO compensation due me/us. By signing here, I acknowledge acceptance of these terms and conditions for use and authorize REDFISH RENTALS to charge my credit card or room account for any lost, stolen or damaged rental items.
Release of Liability, Waiver of Claims and Indemnity Agreement
In consideration for being allowed to participate in the above-described activities, as well as the use of any of the facilities and/or the equipment, I hereby agree to hold harmless, release, indemnify and defend REDFISH RENTALS and its subsidiaries and affiliates, their respective officers, directors, agents, servants and employees, of and from any liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage or injury, including death, that may be sustained by me while participating in these activities, including, but not limited to, those injuries and damages caused by the negligence and or breach of warranty, express or implied, on the part of REDFISH RENTALS, and its subsidiaries and affiliates, their respective officers, directors, agents, servants and employees, now or in the future. By entering into this Agreement, I am not relying on any oral or written representation/statements other than what is set forth in this Agreement. The undersigned acknowledges that REDFISH RENTALS, its agents, employees and affiliates have made no representations or warranties to you and that all activities have been undertaken by you based on your own knowledge, assumption of risk, and experience.
I hereby declare that I am at least 18 years of age and am competent to sign this Agreement. If a minor (UNDER 18) will be participating, I declare that I am a parent and/ or legal guardian and have the authority to sign on behalf of minor participant and that the parent or legal guardian of a minor participant is in complete understanding and concurrence with this Agreement.
I have read this Agreement and Release, understand that I/We have given up substantial rights by signing it, have not changed it orally, sign it voluntarily and I agree to be bound by it.
Cancellation Policy
Refunds
All refunds for are subject to 3.5% fee.
Coastal Weather Policy
Due to the unpredictable weather conditions on the gulf coast, Redfish Rents reserves the right to delay service in the case of inclement weather service. In the same sense, Redfish also reserves the right to expedite pick up if inclement weather is present. No refunds will be given if Redfish Rentals or South Walton Beach Service Association expediting or delaying service. Streat Legal Golf carts will not be refunded for inclement weather. In the event that the state declares an emergency for Destin or surrounding areas, then refunds will be issue if services cannot be rendered.
Beach Chairs
In the event you need to cancel your beach service, reservations greater than 14 days will be fully refunded.
If your reservation is within 14 days from service, you will be refunded 50% of the total amount paid.
If it is the day of service, then no refund will be granted.
Same day reservations will not be refunded for discretionary cancellation.
No refund will be given after rental period has started.
Modifications to beach days must be completed prior to reservation starts. Redfish Rentals will not move beach days once reservation has started; however, additional days can be added.
Inclement Weather: Reservations will not be refunded. Attendants will reopen the beach as soon as its safe for patrons to return to the beach. In the event that the coastal winds increase to a level that flying umbrellas become a risk to other patrons on the beach, we will shut the umbrella till winds decrease to a safe operating level. No refunds will be given if the attendant has to close the umbrellas. Safe operating levels are based off of weather apps and are at the attendant's discretion.
Golf Carts
In the event you need to cancel your street legal golf cart, reservations greater than 21 days or 3 weeks will be fully refunded.
If your reservation is within 21 days from service, you will be refunded 50% of the total amount paid.
If it is the day of service, then no refund will be granted.
Same day reservations will not be refunded for discretionary cancellation.
No refund will be given after rental period has started.
Variations of carts: All carts have some variability with respect to color, style of seats, roof-top length, and slight speed differences. No Refunds will be given for variations.
Inclement Weather: Reservations will not be refunded for weather related issues unless a state of emergency is in place for Destin and surrounding areas causing Redfish Rentals to disrupt service.
Redfish Rentals takes pride in maintenance; however, because street legal golf carts due have mechanical failures from time to time, we will make every effort to get you another street legal cart. Should we not be able to accommodate with another cart, we will refund the remainder of your reservation.
Beach Cruiser Bicycles
In the event you need to cancel your beach cruiser bicycle, reservations greater than 14 days will be fully refunded.
If your reservation is within 14 days from service, you will be refunded 50% of the total amount paid.
If it is the day of service, then no refund will be granted.
Same day reservations will not be refunded for discretionary cancellation.
Inclement Weather: Reservations will not be refunded for weather related issues unless a state of emergency is in place for Destin and surrounding areas causing Redfish Rentals to disrupt service.
Redfish Rentals takes pride in maintenance; however, because bicycles due have mechanical failures from time to time, we will make every effort to get you another bicycle. Should we not be able to accommodate with another cart, we will refund the remainder of your reservation.
Bank Disputes and Chargebacks
In the event that you "the customer" dispute back to your bank against the policies listed above, it will be met with legal action in the form of small claims dispute. We will make every effort to work through refunds with you. Should have questions please call us directly at 850-714-4810.
