Vacation Rental Agreement
This Vacation Rental Agreement is entered into by and between The person who's name appears on the credit card used for this transaction and Ozarks Fun Rentals LLC.
Term of Lease:This lease begins at 4pm the first day selected on the reservation calendar (Check-in Date) and ends at 10 am the last day selected on the reservation calendar. (Check-out Date).
Payment:Guest shall pay to Agent a reservation payment in the amount of 50% of the rental due and payable upon execution of this Agreement, and the balance within 30 days prior to arrival. The Balance includes a housekeeping fee in the amount listed on your check-out quote. Also a damage deposit in the amount of $250 will be required. The damage deposit will be waved provided you purchase a Security Deposit Protection Plan. Acceptable payment options are cash, personal check, money order or Credit card.
Cancellation Policy: In the event of Guest cancellation a fee of $75 will be charged if the cancellation occurs prior to 30 days of arrival date. All deposits will be returned to you less the $75 cancellation fee. Any cancellations occurring within 30 days of arrival date will result in forfeiture of your reservation deposit. Trip insurance is available at time of reservation.
Refund of Deposit: All deposits will be refunded by check payable to the first Guest listed on this agreement within 30 days of Guest Check-out Date. If any amounts are subtracted from Guests deposit refund, a complete invoice will be provided to Guest along with any partial deposit refund.
Check In/Check Out: Check in time is 4:00 PM local time. Check Out time is 10:00 AM local time. Exceptions to Check In or Check Out will be made based on availability. In no case will exceptions exceed 2 hours either way. You must notify Ozark Fun Rentals within 24 hours if you desire early Check In or late Check Out.
Occupancy: The maximum number of guest allowed at this Property is listed in the booking section. In the event the actual number of guests exceeds that which is allowed, a fine of $50 per person over the limit will be assessed.
Pets: Some Property owners will allow dogs and/or cats. Certain restrictions may apply such as size and number of animals etc. In no case will reptiles or mammals other than dogs or cats be allowed. A deposit of $500 will be charged on all reservations that include pets. In the event extra expenses for housekeeping, carpet cleaning or damage repair is required due to your pets they will be deducted from the deposit. If damage exceeds the amount of the deposit you will be held responsible. Your Pet deposit will be returned to you within 30 days of check out, less any expenses incurred for extra services.
Hospitality: Upon arrival you will find stocked in your unit, a supply of dish and laundry detergents, hospitality items including soap, shampoo, lotion and paper products. Please bring your own beach towels. Do not use towels from your unit for other than bathing.
Governing Law: This agreement shall be governed by the laws of the state of Missouri. Each of the parties irrevocably consents to the exclusive personal jurisdiction of the federal and state courts located in Missouri, as applicable, for any matter arising out of or relating to this Agreement.
Indemnification: Guest agrees to indemnify and hold Agent and Property owner harmless from any liability for personal injury or property damage sustained by Guest or parties invited onto the property by Guest.
Security: During your stay you are responsible for the security of the property. Make sure that all doors are locked when you are away from the property and that keys are returned to the key lock-box. In the event you lock yourself out of the property, you may call our 24 hour emergency number 417-559-1859. The fee for lockout service is $50 and will be charged to you. In the event the property is equipped with an electronic combination door lock instead of a keyed lock, and the lock should fail there will be no charge for lockout service.
Smoking: Smoking is not permitted in any of our units. In addition to a $200 fine, you will be held responsible for the cost of cleaning carpets, drapes and bedspreads and deodorizing if you smoke in the unit.
Noise: Any noise or disturbance that results in a complaint from other residents to either the Agent or the police may result in eviction. At the sole discretion of Ozark Fun Rentals you will either be asked to cease the disturbing activity or you will be asked to leave. Under no circumstances, after receiving a second complaint will you be permitted to occupy the property.
Illegal Activities: Any violation of Local, State or Federal law will result in immediate eviction and forfeiture of all payments and deposits. This includes but is not limited to underage drinking, Possession of illegal drugs, possession of firearms and fighting.
Age Requirements: You must be at least 21 years of age to rent and occupy one of our units. All persons under 21 must be accompanied by a Parent or Guardian that is staying in the unit. Forfeiture of all payments and deposits will result if it is determined that the reservation was made under false pretenses.
Special Circumstances: Ozark Fun Rentals will not be responsible for unforeseen conditions that might occur. Although rare, electrical outages and equipment failure do occur. Failure of Appliances, TVs, air conditioners, water heaters, jetted tubs etc. will not result in refund of any payments or deposits. In addition no refunds will be made due to the effects of adverse weather conditions regarding your reservation.
Maintenance: Report any maintenance issues immediately to Ozark Fun Rentals at 417-559-5056. After 10:00PM you can call our after hours emergency number at 417-559-1859.
Damages: Once you have checked out of the unit, it will be inspected for damage. If any damage is reported it will be documented. Once repairs have been made your damage deposit will be returned to you less the proper deduction for the repairs. You will be given a full accounting of repairs including vendor receipts. If it is determined that damage exceeds the damage deposit a charge of $1000 will be made to your credit card. Again, once repairs are made all remaining funds will be credited back to the credit card on file. If for any reason damage repairs exceed $1000, you will be billed for the excess. Payment will be due within 10 days of billing.
Rules: It will be your responsibility to read and abide by the rules and regulations as outlined in your guest book located in your unit.
Legal Fees: In the event legal fees are incurred by Ozark Fun Rentals regarding enforcement of the terms of this agreement, you will be responsible for said fees. This includes any Attorneys fees and associated court costs.
By submitting your credit card for payment you are agreeing to the terms and conditions as set forth in this agreement.

All reservations are subject to the terms of our CANCELLATION / REFUND POLICY.
Our policies are designed to be fair to all of our guests. Please understand that when we accept and confirm your reservation, this means we turn away all other requests. The following policy is designed to inform you to the best of our abilities about our cancellation and refund policy, and to protect our business. Please note that in order to make a reservation, you must be 21 years of age. Rates are subject to change at any time prior to your confirmation. We must charge 8.475% government tax in addition to the room rates and cleaning fee.

NO-SHOW AND EARLY-DEPARTURES POLICY
No Shows and Early Departures will be charged fully for all nights reserved.
WEATHER CONDITIONS
No refunds will be considered for weather conditions. Due to the unpredictability of the weather.
