Rental Agreement In an effort to make everyone's stay as pleasant as possible, Blue Sky Escapes has adopted these Terms and Conditions which shall apply to all Guests. By making a reservation with us, you agree to the following Terms and Conditions:
Minimum Stay: Seven night minimum stay required (14 night minimum stay over Christmas season Dec. 15th - Jan. 6th).
Rental Payment: 25% of your invoice is due at time of booking with the final balance due 90 days prior to arrival.
Taxes: Tax of 17.92% is added to all reservations (13.25% hotel tax and 4.57% state tax).
Cancellation Policy: CONDOS: If notice is received 90 days or more prior to arrival date, a full refund will be issued minus a $250 cancellation fee. If notice is received within 90 days of arrival, we are unable to issue a refund, unless we are able to re-book, then we will refund you the days we are able to re-book minus a $250 cancellation fee. Transaction fee cannot be refunded.
Rental Home: Deposit is non-refundable. If notice is received within 90 days of arrival, we are unable to issue a refund, unless we are able to re-book, then we will refund you the days we are able to re-book minus a $1000 cancellation fee. Transaction fee cannot be refunded.
Credit Card Authorization: I understand and consent to the use of the credit card provided without my original signature on the charge slip, and that this Credit Card Authorization cannot be revoked and will not terminate until 30 days after the premises are vacated. Charges may include, but not be limited to damages beyond normal wear and tear.
Severe Weather: As we all know, the weather here is tropical but can be uncertain. We therefore do not refund Rents or Deposits due to canceled or shortened stays because of weather. Departures due to inclement weather do not warrant a refund of Rent or Deposit.
Cleaning: There is a one-time cleaning fee. An initial set of toiletries are provided. Extra items needed are the responsibility of the Guest.
All units are NON-SMOKING both inside and outside on the lanai.
Check-Out Procedures: We know you are on vacation and we do appreciate your business. But we do have to ask that you abide by our Check-Out Procedures. The main reason for this is so we can get the unit ready for the next guests, who often arrive only hours after you leave. We accommodate late check out and early check in when available for an additional fee. Please check with us. If you leave the Unit in good shape, the next family can have access to the Unit on time. We really appreciate you following these procedures:
1. Check-out time is by 10:00 am. 2. Please clean all dishes and run the dishwasher 3. Gather all the towels in a pile. 4. Take all of the trash to the bins by the parking lot entrance. 5. Turn off the a/c 6. Leave the keys inside the unit and close the door behind you.
Please leave the Unit neat and orderly to avoid additional charges. If the cleaning crew finds that the Unit has been left excessively dirty, you will be billed for the additional cleaning time. If the cleaning crew detects any evidence of smoking in the units you will be billed an additional $1,000 to deodorize the unit. Please leave the house in as good as shape as possible. We appreciate your help.
Additional charge of $10/night per person for more than two guests in condos and $20/night per person for more than 6 guests (max 7 guests allowed) including all children in Cloud 9.
Arriving with more than than the number of guests (including children and babies) as per your reservation confirmation forfeits your reservation and no refunds will be offered.
Due to county vacation rental home license requirements, please be aware that my Maui rental house is for the exclusive use of registered guests only so you will be unable to have large group gatherings on the property for shared meals, pool/hottub activity etc. Ignoring this requirement forfeits your reservation and no refund will be offered.
Guest agrees that all guests will observe all Terms and Conditions of this Agreement so as to maintain the Premises in good order and appearance, and that all will conduct themselves in a manner inoffensive to neighbors.
Guest agrees that any guest who violates any of the Terms and Conditions of this Agreement may be immediately denied access to the premises in the sole discretion of Blue Sky Escapes.
Guest agrees that any guest using drugs or allows others to use drugs on the Premises will be subject to immediate removal from the Premises, by force if necessary, and denied any further access to a Unit or the Premises in the sole discretion of Fern Grotto Inn.
Guest shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the Premises for any unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance on or about the Premises or the Unit.
Guest agrees that denial of access to the Premises or Unit by Blue Sky Escapes for any purpose described herein or other violation of the Terms and Conditions of this Agreement in the sole discretion of Blue Sky Escapes shall not warrant any refund of Rent or Deposit.
Guest agrees that they are responsible for any and all damages that occur to the Units, Premises or any contents caused by you or any other member of your group, individually or collectively, while you are the registered occupant of a Unit. Any damage noticed upon arrival should be reported to Blue Sky Escapes immediately.
Guest agrees that you are liable for any damages to the Unit or Premises and/or for any injuries to persons caused by the conduct or actions of Guest and your guests and/or invitees. You further agree that Blue Sky Escapes shall not be liable to Guest, your guests and/or invitees for any such damages and that Guest agrees to indemnify and hold Blue Sky Escapes harmless from any and all claims, action, demands, liability or causes of action (including reasonable and necessary attorneys fees incurred by Blue Sky Escapes for defense against any such matter) that Blue Sky Escapes may incur or be liable for arising out of Guest occupation of a Unit or the Premises.
In the event that any action shall be commenced by either party arising out of, or concerning this Agreement or any right or obligation derived therefrom, the prevailing party shall be entitled to recover reasonable and necessary attorneys fees as fixed by the Court in addition to all relief at law or equity.
The Policies and Procedures above are meant to protect our Guests and owners alike. All Guests are required to conform to and comply with all Policies and Procedures.
