WAIVER & RELEASE AGREEMENT

Please read carefully before signing. This is a release of liability and waiver of certain legal rights. In consideration of services or goods provided by Trappers Lake Lodge and/or Wilderness Escapes, LLC (jointly and severally "Trappers Lake Lodge") including the use of the property, horses, non-motorized watercraft, or facilities furnished by Trappers Lake Lodge, the below signed person(s) jointly and severally if more than one, agree(s) as follows for the group members:

We acknowledge that the elimination of all inherent risks, hazards and dangers in horseback riding, boating, hiking, fishing, hunting, and other outdoor activities is unattainable, particularly in a wilderness environment.

WE UNDERSTAND THAT THESE RISKS, HAZARDS AND DANGERS INCLUDE WITHOUT LIMITATION:

1. The propensity of animals to behave in ways that may result in injury, harm or death to persons around them;

2. The unpredictability of animal reactions to such things as sounds, sudden movement, unfamiliar objects, persons, or other animals;

3. Certain hazards such as surface, sub-surface, and environmental conditions;

4. The risk of operating non-motorized watercraft;

5. Hiking in rugged country;

6. Encounters with wildlife, plants, animals, and insects;

7. Temperature extremes;

8. Inclement weather conditions;

9. The unavailability of immediate medical attention in case of injury; and

10. The risk of firearms and from those who possess firearms.

We understand the risks, hazards, and dangers described above and the responsibilities described below and have discussed them and/or had the opportunity to discuss them with Trappers Lake Lodge and with others. We understand that some outdoor activities require good physical conditioning and a degree of skill and knowledge. Those of us who choose to engage in these activities are in suitable physical condition and possess the degree of skill and knowledge necessary. We all understand our responsibilities regarding resource protection and permitted use of this environment. Our participation in these activities is purely voluntary. We assume all risks of being in an outdoor or wilderness environment whether the risks are obvious or not. No one forced us to participate and we elect to participate in spite of the risks. WE UNDERSTAND THE INHERENT RISKS, HAZARDS AND DANGERS INVOLVED AND HEREBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE. We also promise to abide by all current Forest Service regulations and requirements. Therefore, we, for ourselves, all others of the group, our heirs, successors, executors, assigns, and subrogees, hereby FREELY, KNOWINGLY, AND INTENTIONALLY WAIVE LIABILITY AND DO RELEASE, AND WILL INDEMNIFY AND HOLD HARMLESS, TRAPPERS LAKE LODGE, their respective directors, members, managers, assigns, officers, agents, employees, and volunteers from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including costs, expenses, and attorney's fees incurred by such persons released) which arise from, are related to, or are in any way connected with our participation in or our exposure to these activities or use of property, equipment, or facilities from any cause including, but not limited to, the NEGLIGENCE of Trappers Lake Lodge or any other waivable, releasable, or indemnifiable cause. We, for ourselves, our heirs, our successors, executors, assigns, or subrogees further agree not to sue Trappers Lake Lodge as a result of any such injury, death, or property damage suffered or incurred. UNDER COLORADO LAW, AN EQUINE PROFESSIONAL IS NOT LIABLE FOR ANY INJURY TO OR THE DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE ACTIVITIES PURSUANT TO SECTION 13-21-120, COLORADO REVISED STATUTES. We further agree not to slander, libel, defame, or disparage Trappers Lake Lodge in any manner or harm or cause injury to the business, goodwill, or reputation of Trappers Lake Lodge under any circumstances. We also agree to indemnify and repay Trappers Lake Lodge for all of their attorney fees, costs, damages, and expenses resulting from any breach of this Agreement.

We represent that we are authorized to sign and are signing this Waiver and Release Agreement on behalf of ourselves and on behalf of all members of the group including adults and minor(s) or other legally incapacitated persons. The plural number shall include the singular in this Agreement. This Agreement binds our heirs, successors, executors, assigns, and subrogees, as well as, all minor(s) or other legally incapacitated persons in our group together with their heirs, successors, assigns, executors, and subrogees.

I HAVE READ, UNDERSTAND, AGREE AND ACCEPTED ALL TERMS OF THIS AGREEMENT, and acknowledges that it shall be effective and binding upon all Parties.

CANCELLATION POLICY
30 days notice. A nonrefundable deposit, 50% deposit of the total stay in the cabin(s) reserved, is required in order to secure the reservation. The remaining balance will be due upon arrival. Deposits are non-refundable. To avoid being charged the remaining amount of your stay, you must cancel 30 days prior to your arrival date. Should you cancel within the 30 days prior to arrival, you will be billed for the remaining amount of your planned visit.


RENTAL AGREEMENT
Please read carefully before signing. In consideration of services or goods provided by Trappers Lake Lodge and/or Wilderness Escapes, LLC (jointly and severally "Trappers Lake Lodge") including the use of the property, horses, non-motorized watercraft, or facilities furnished by Trappers Lake Lodge, the below signed person(s) jointly and severally if more than one, agree(s) as follows for the group members:

1. Smoking is NOT allowed inside any of the cabins. Under Colorado State Law, a $250.00 fine will be charged by not complying.

2. People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest.

3. Guests should not create excessive noise at a level that disturbs neighbors; enforced property quiet hours are from 10:00p.m. – 7:00a.m.

4. Wilderness Escapes, LLC dba Trappers Lake Lodge is not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

5. Keep the property and all furnishings in good order.

6. Only use appliances for their intended uses.

7. We are a pet friendly resort. A pet fee of $15 per pet, per night will be charged. Pets are NOT allowed on any of the furniture in the cabins. Please bring proper bedding for your pets. Failure to keep pets off of the furniture will result in $100.00 cleaning fee.

8. Do not cut branches off of live trees. Violators will be fined $100.00.

9. Do not carve on any of the buildings located on the property. Cabins are checked upon check-out. Any new carvings occurring during your stay will result in a $500.00 fine.

10. We do have livestock on the property. Please do not allow unattended children to play near the stock. DO NOT visit the horses or mules without the approval and supervision of a manager. Even though they are domestic animals they can be dangerous without proper supervision. Failure to abide by these rules could result in serious injury or death.

11. No refunds will be given for storms; however, if unable to attend because of weather we will try to reschedule a visit in the same season, in which your credit can be applied. Mountain roads can be curvy and steep. Gravel roads are well maintained; however, we highly recommend four wheel drive and/or chains during the snow months. We do not refund due to road conditions.

12. Please do not use any of the wood burning stoves located in the cabins. They have been disconnected and are not fully operational.

13. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the units.

14. Garbage: Any garbage must be stowed in the proper garbage or recycling receptacle, located inside each cabin.

15. Cancellation Policy: At the time of reservation, a 50% non-refundable deposit is collected.

Cabin Cancellation - 30 days notice. At the time of your reservation there is a 50% non-refundable deposit for each cabin reserved. Deposits are non-refundable. To avoid being charged the remaining amount of your stay, you must cancel 30 days prior to your arrival date. Should you cancel within the 30 days prior to arrival, you will be billed for the remaining amount of your planned visit.
Hunting Reservations (August 31st - October 31st) - 150 day advance notice for hunting season reservations.
Please notify us within the above time frame to avoid full charges for any reservations or services. We are not responsible for natural events, weather or illness that may cause cancellation after the cancellation period.
