WAIVER AND RELEASE FROM LIABILITY FOR OWNER OF RV PARK


I HEREBY WAIVE AND RELEASE, indemnify, hold harmless and forever discharge Lost Maples RV and Camping and its agents, employees, officers, directors, affiliates, managers, volunteers, successors, and assigns, of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages, and liabilities, of every kind and nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my participation in any of the events or activities conducted by, on the premises of, or for the benefit of Lost Maples RV and Camping provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful, or wanton misconduct.

I understand that the activities in which I will participate are inherently dangerous and may result in serious or grievous injuries, including bodily injury, damage to personal property, and/or death. On behalf of myself, my heirs, assigns and next of kin, I waive all claims for damages, injuries, and death sustained to me or my property that I may have against the aforementioned released party to such activity.

By the WAIVER, I assume any risk, and take full responsibility, and waive any claims of personal injury, death, or damage to personal property associated with Lost Maples RV and Camping including but not limited to engaging in general camping activities, use of the facility and its equipment, and/or engaging in other related activities on and off the premises.

This WAIVER AND RELEASE contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of the WAIVER AND RELEASE. The provisions of this WAIVER AND RELEASE may be waived, altered, amended, or repealed, in whole or in part, only upon the prior written consent of all parties.

The provisions of this WAIVER AND RELEASE will continue in full force and effect even after the termination of the activities conducted by, on the premises of, or for the benefit of Lost Maples RV and Camping, whether by agreement, by operation of law, or otherwise. If any provision of this WAIVER AND RELEASE or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications that can be given effect with the invalid provision or application, and to this end the provisions are severable. In lieu thereof there shall be added a provision as similar in terms to such illegal, invalidate, and unenforceable provision as may be possible and be legal, valid and enforceable.

This Agreement shall be governed, enforced, and interpreted according to the laws of the State of Texas.

I have read, understand, and fully agree to the terms of this WAIVER AND RELEASE. I understand and confirm that by signing this WAIVER AND RELEASE I have given up considerable future legal rights. I have signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise, or guarantee being communicated to me. My signature is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE of all liability to the full extent of the law. I am 18 years of age or older and mentally competent to enter into this waiver. This agreement and its terms and provision will include any minors who accompany me or who are under my care. I further agree that I shall assume responsibility for watching and caring for minor (’s) safety and guarding against all hazards, natural or man-made, whether expressly mentioned in this WAIVER AND RELEASE or otherwise.

**ANY RESERVATION CANCELLED PAST 120 DAYS FROM THE DATE THE RESERVATION WAS MADE IS NON-REFUNDABLE**

CANCELLATION POLICY

Cabin Reservations:
• Cancel prior to 5 days before check-in and you will receive a refund minus the $50.00 non-refundable portion of your deposit as well as the 4% non-cash charge.
• Cancel up to 5 days before check-in, but prior to 48 hours, the first night is non-refundable, the remaining nights will not be charged.
• Cancel within 48 hours of your reservation, you will be charged for the full reservation. This also applies to “No Shows”.

RV and Tent Site Reservations:
• Cancel prior to 5 days before check-in and you will receive a refund minus the 4% non-cash charge.
• Cancel up to 5 days before check-in, but prior to 48 hours, the first night is non-refundable, the remaining nights will not be charged.
• Cancel within 48 hours of your reservation, you will be charged for the full reservation. This also applies to “No Shows”.

Effective January 1st, 2022, a 4% Non-Cash Charge will be added to any purchase made with a credit or debit card.
