Docking Agreement
Lakeside Park Marina – West Harbour Wall
Docking Terms & Conditions
By completing your reservation and payment, you agree to the following Terms & Conditions:
⸻
1. Waiver of Liability
Lakeside Park Marina (LPM) does not provide insurance coverage for vessels. Docking fees do not include protection for loss or damage due to fire, theft, accident, weather, or other causes. Docking is at your own risk.
By docking at the West Harbour Wall, you agree to release, indemnify, and hold harmless LPM, its staff, operators, and representatives from any claims, damages, injuries, or losses—including those arising from negligence.
Dock staff are not responsible for docking, navigating, or maneuvering your vessel. It is the vessel operator’s sole responsibility to determine whether the available or recommended docking location is appropriate and safe.
⸻
2. Insurance Requirement
All vessels must carry valid insurance with a minimum of $1,000,000 in third-party liability coverage. Insurance must remain active for the duration of your stay.
⸻
3. Agreement to Terms
These Terms & Conditions apply to all persons using docking areas at the West Harbour Wall. Payment of docking fees constitutes acceptance of these Terms.
⸻
4. Use of Docking Area
• Docking is permitted for recreational use only. Commercial activity (charters, rentals, tours, etc.) is not allowed without written approval from LPM.
• Vessels must remain within their assigned docking boundaries. If the vessel is longer than declared, charges will be adjusted based on the true overall length, and relocation may be required.
• A minimum two-point tie is required. Spring lines are recommended. Mooring lines must be secure, non-chafed, and sized appropriately.
• If lines or onboard equipment are deemed unsafe, staff reserves the right to refuse docking.
⸻
5. Conduct Expectations
All owners, guests, and crew must act respectfully and safely. Disruptive or unsafe behavior may result in immediate removal from the West Harbour Wall and cancellation of docking access.
LPM may update its rules at any time. Changes take effect upon being posted or communicated by staff.
⸻
6. Speed & Safety
• Speed Limit: Vessels must operate at 6 knots or less – NO WAKE when approaching, departing, or near the West Harbour Wall.
• Boarding Rights: LPM reserves the right to board any vessel in the event of an emergency or hazard to others, the environment, or property.
• Electrical Hookup: All power pedestals are GFCI-protected. If a vessel trips the circuit, staff may deny access to shore power. Prepaid power fees will be refunded, but docking fees are still payable.
⸻
7. Environmental Regulations
No fuel, oil, lubricants, sewage, grey water, or hazardous materials may be discharged into Lake Ontario.
Refinishing or cleaning waste must be properly handled offsite. All spills must be reported and cleaned up immediately by the vessel owner.
⸻
8. Sunken Vessels
If your vessel sinks within Port Dalhousie Harbour, you must arrange for immediate removal.
If action is not taken promptly, LPM will coordinate removal and bill all associated costs, including environmental cleanup, to the vessel owner.
