Rental Agreement
Renter Agrees to the following terms and conditions.
1. Family Boat Rental's ability to provide a rental boat, if reserved, is contingent upon and subject to the return of the boat by the previous Renter, or any cause beyond the Owner’s control.
1.1 Renter will not be billed for any lost rental time due to boat unavailability.
1.2 Family Boat Rental's responsibility for lost rental time will not exceed the amount charged for that rental time.
2. CONDITION OF BOAT:
2.1 The Renter certifies that he/she has picked up the boat then they have examined the boat and equipment and finds it acceptable and suitable for the purpose for which it was rented, and that other accessory equipment is in suitable and acceptable condition; that he/she will maintain both boat and equipment in a safe and dependable condition while in his/her custody.
2.2 After acceptance of the rental boat, Renter agrees to immediately report any accident, malfunction, breakdown or defect to Owner. Continued use of the rental boat and equipment shall be entirely at the RENTER’S risk and thus RENTER assumes all liabilities of injury and damage to all persons and property that may become involved by its continued use.
2.3 The Renter agrees to return the boat and equipment in same condition as when taken, ordinary wear and tear expected. A cash bond or equivalent deposit shall be retained by Owner as partial compensation for failing to return said rental boat in as good condition, ordinary wear and tear excepted, as when received, for reimbursement of article damaged, missing or broken, or to be applied to the rental charges upon return of the boat by Renter.
2.4 Renter agrees that he/she will be held liable for any lost revenue due to damage to the rental boat.
3. USE OF BOAT & EXCLUSIONS:
3.1 The Renter agrees to restrict the operation of the boat to the protected waters of Great Sacandaga Lake. The Renter is not permitted to operate the boat beyond this permitted area without the prior written consent of Owner.
3.2 The Renter certifies that he/she will operate the rental boat in accordance with all NYS safety rules and regulations.
3.3 The Renter certifies he/she is at least 25 years of age and will not use the boat for any unlawful purpose.
3.4 The rental boat shall not be operated by any other person other than the Renter stipulated in 1.2 above without the written permission of the Owner.
3.5 The Renter agrees that that the boat shall be used exclusively as a pleasure vessel for the safe and proper use of the Renter, his family or guests during the terms of this agreement and shall not be used to transport merchandise, tow another vessel, nor passenger for hire or pay.
3.6 The Renter agrees not to use the boat in a careless or neglectful manner.
3.7 The Renter agrees not to use the boat while under the influence of alcohol and/or narcotic.
3.8 The rental boat shall not be used to carry passengers in excess of the weight or passenger capacity stipulated on the coast guard placard on the boat - 12 people maximum on boat.
3.9 The Renter agrees and understands that the use of rental boats is prohibited from dusk to dawn. Should the Renter choose to ignore this policy and damage occurs, said Renter will be 100% liable for all damages.
3.10 The rental boat shall not be used for any race or in any competition.
3.11 There is no towing or tubing of any kind.
3.12 There is no racing.
3.13 There are no pets permitted on the boat.
4. QUALIFICATIONS & RESPONSIBILITIES:
4.1 Renter certifies that he/she is experienced and qualified properly to handle the boat and will be the sole operator of the vessel. Further, Renter states that he/she is physically and legally qualified to operate the above-‐described boat. Renter certifies that they have the licenses as required by New York State at the time of the rental.
4.2 Renter acknowledges his/her responsibility for the safe and proper operation of the boat; and for the safety and welfare of other boaters and persons. It is AGREED AND UNDERSTOOD BY RENTER that OWNER shall not be held liable for damages, inconvenience of time lost caused by accident, breakdown or malfunction of the boat. RENTER FURTHER AGREES to
indemnify and hold harmless the OWNER from, and against any and all claims for loss or damage to property or injury to persons (including death) resulting from the use, operation or possession of said boat, including loss or damage caused by fire, water, theft, or any cause whatsoever.
4.3 Renter acknowledges his/her responsibility to ensure that each person on the rental boat under the age of twelve is wearing a securely fastened United States Coast Guard approved wearable personable floatation device of an appropriate size when the rental boat is underway.
4.4 For rental boats less than twenty one feet, Renter acknowledges his/her responsibility to ensure that each person on board the boat is wearing a securely fastened United States Coast Guard approved wearable personable floatation device of an appropriate size when the rental boat is underway.
4.5 For overnight Rentals the renter is responsible for the proper mooring or docking of the boat, and they affirm that they have the proper facilities to do so.
4.6 Renter will notify Family Boat Rental immediately of any incidents with the boat, such as collision, motor impact with object or anything other than normal operation of the boat.
5. PICK UP AND RETURN OF RENTAL BOAT
5.1 Boats must be returned at the specified date and time. If renter arrives to pick up the boat more than one hour later than the specified pick up time the rental boat may not be available for pickup but you will still be billed for that day. Arrangements can be made on a case by case basis for a non-standard pick up and drop off time.
5.2 If the boat is not returned on time, the renter will be billed $25 per 15 minutes late. If the boat is not returned by 6:00 PM EST, the renter will be billed for an additional day and any loss of business that results.
5.3 Boats returned without a full tank of Gas will be billed $9 per gallon for refueling and a $50 Refueling fee.
6. WEATHER
6.1 The rental pickup will not be canceled due to inclement weather so long as it is safe to boat. Unsafe weather may be cause for a reduced number of rental days or a delayed pickup time at Family Boat Rental's discretion. Family Boat Rental will use its best efforts to accommodate weather situations, but renter acknowledges that weather conditions are not in Family Boat Rental's control and therefore not Family Boat Rental's responsibility.
7. CANCELLATION
7.1 Cancellations are allowed with at least 30 days advanced notice to Family Boat Rental.
7.2 Cancellations with less than 30 days notice are not allowed, the renter is responsible for the full rental amount.
Cancellation Policy
There is no cancellation in under 30 Days.
If you want to cancel regardless, we will make the boat available and if it books, we will refund your money less a $150 fee.
