Rental Agreement Vacation Rental Agreement: Terms and Conditions These Terms and Conditions clarify Pineridge Cottages Limited’s obligations to The Guest(s), The Guests’ obligations to Pineridge Cottages Limited, and in the very unlikely event of any disputes, will be used as the basis for any resolution. Please read them carefully before confirming your booking. Acceptance of these Terms & Conditions binds a contract between the following two parties: The Rental Applicant (The Lead Guest) and Pineridge Cottages Limited 1. Party Members All persons listed on the Rental Application or added and approved subsequently by Pineridge Cottages Limited will be bound by these Terms and Conditions. Occupancy of the property is restricted to those names listed on the Application (the Rental Group) or added subsequently by Pineridge Cottages Limited. The Rental Applicant is considered to be the Lead Guest and will assume full responsibility for all members of their Rental Group throughout the rental period. Information or instructions relating to this rental will be communicated to the Lead Guest only and not to any third-party member of the Rental Group. It is the responsibility of the Lead Guest to ensure that members of their Rental Group are aware of and abide by all the terms and conditions contained herein. 2. Arrival & Departure 2. 1 Check-in is between 4:00 pm and 9:00 pm and check-out is 10:00 am. If a check-in after 9:00 pm is required, guests must notify Pineridge Cottages Limited and receive written confirmation of agreement to the late check-in. 2.2 Additional costs may be incurred by Pineridge Cottages Limited for cleaning teams due to early arrivals or late departures. A charge may be levied for any early arrival or late departure causing disruption to property access by Pineridge Cottages Limited, up to the full amount of the damage deposit, in addition to any additional costs incurred in relation to delayed access to the property for preparation for the next reservation. In addition, an administrative fee of up to $200 may be added to any early arrival or late departure causing disruption to property access by Pineridge Cottages Limited Staff and cleaning team. 3. Credit Card Guarantee: Security and Cleaning Deposit Pineridge Cottages Limited shall be entitled to collect from the Lead Guest a returnable $200 Security and $50 Cleaning Deposits upon check-in, for the undertaking of the rental. The Security Deposit can be fully forfeited should any member of the Rental Group violate the terms and conditions of the Vacation Rental Agreement. 3.1 Accidental Damage may occur and is the responsibility of the Lead Guest. The Lead Guest may be asked about the circumstances around the damage. 3.2 Pineridge Cottages Limited reserves the right to be the final arbiter in any malicious damage and to determine the amount of any full or partial payment taken from the Security Deposit. 3.3 The Lead Guest shall be solely responsible for any and all malicious damages caused, internet charges incurred, clean up from pets or smoking regardless of which member of in their Rental Group caused or incurred the damage or charges for whatever reason, during the rental period. 3.4 The Lead Guest shall advise Pineridge Cottages Limited, immediately of any problems, deficiencies or concerns with the rental property, and is encouraged to document such issues to avoid penalty. Additionally, the Lead Guest must also disclose any concerns or damage, should anything arise during the rental period. 3.5 The Lead Guest shall ensure that the maximum occupancy of the rental property is not exceeded, and that occupancy is limited to those persons stated as part of their Rental Group on the Rental Application form that was submitted and approved. Failure to comply will result in forfeit of the security deposit. 3.6 The Lead Guest agrees to pay a handling fee and postage fees for returning items left behind by themselves or members of their Rental Group. The Security Deposit shall be taken and held in trust until an inspection of the rental property can be completed, after check-out, to confirm that there is no loss or damage. Pineridge Cottages Limited will return the security deposit in the same manner in which it was paid. 4. Payments 4.1 Reservations shall be confirmed in writing by Pineridge Cottages Limited upon the receipt of a 10% non-refundable booking deposit within a specified time period once the reservation request is made. Receipt of any deposit prior to Pineridge Cottages Limited’s written confirmation of the reservation shall not constitute acceptance of any booking. 4.2 A 30% deposit shall be payable on April 1, 2024 OR 90 day prior to your arrival (whichever comes first) for all rentals. 4.3 The balance of payment is due upon check-in. All payments shall be made to Pineridge Cottages Limited by credit card, debit, cash, or email money transfer. 4.4 Once a reservation is received and accepted by Pineridge Cottages Limited, The Lead Guest is liable for payment of the balance of the rental deposits within the scheduled time frames. Non-payment of the 10% booking deposit within the specified time-period or the 30% by the April 1, 2024/ 90 days prior to arrival dues dates will be treated as a cancellation and the deposit will be forfeited or a late-payment fee of $50 will be applied. 5. Cancellation Policy & Changing a Booking 5.1 Once a reservation has been accepted and confirmed, a cancellation can only be made in accordance with the terms below: • If the period of rental is more than 60 days into the future, a refund for the period re-rented, will be issued less the booking deposit. • If the period of rental is 31-60 in the future, a 50% refund of the paid amount will be refunded less the booking deposit. • If the period of rental is 30 days or less into the future, no refund of deposited funds will be issued. • If the period is less than 14 days, the lead guest will be expected to pay for the full amount of the cottage(s) reserved under the agreement. • If there are 5 or more cottages rented by a group, no refund will be provided for cancellations with less than 60 days notice. Cancellations of less than 30 days notice will require the full amount to be paid. 5.2 Once a reservation has been accepted by Pineridge Cottages Limited, the reservation can only be changed to another cottage by treating the original reservation as a cancellation. The Terms in Clause 5.1 apply. 5.3 Where Pineridge Cottages Limited has the availability to make the change to another cottage or week within the same season (spring/summer/fall), Pineridge Cottages Limited will do so at our discretion. 6. Occupancy of the Property 6.1 The number of guests occupying a Cottage or the Log Home is strictly limited to those named on the Rental Agreement or any subsequent amendment notified in writing to Pineridge Cottages Limited. The stated and agreed occupancy figure includes all persons irrespective of age. An additional charge of $25/per person/per night will be levied on any more than the outlined number of guests per Cabin/Log Home on our website. 6.2 Cottage occupancy limits apply to day guests as well as overnight guests. 6.3 Exceeding the number of stated and agreed persons, regardless of the stated occupancy limit, may result in immediate eviction without refund. 7. Condition of the Property The Property will have been inspected prior to occupation and therefore The Lead Guest will ensure that they and their Rental Group undertakes to: 7.1 Report details of any damage done to a Cottage or The Log Home or any of the furniture, fixtures, fittings and effects to Pineridge Cottages Limited as soon as reasonably possible. 7.2 Keep the Property and all furniture, fixtures, fittings, chattels and effects in or about the Property in the same state of repair and condition as found at the commencement of the Rental. 7.3 Where a cleaning service is provided; The Lead Guest will ensure that they and their Rental Group shall follow the departure instructions provided by Pineridge Cottages Limited. 7.4 Where a cleaning service is not provided; The Lead Guest will ensure that they and their Rental Group shall leave the Property in the same state of cleanliness and general order in which it was found. Failure to do so to the satisfaction of Pineridge Cottages Limited may result in a damage/cleaning charge being levied. 7.5 The Lead Guest will ensure that they and their Rental Group shall remove all garbage & recycling from the property (interior & exterior) and dispose of accordingly in the designated bins, prior to their departure. Failure to remove any waste material will be subject to a removal fee. 8. Access to Cottages/Log Home Pineridge Cottages Limited reserves to right to enter a Cottage or the Log Home during your stay. We will make every effort to provide appropriate notice to the Lead Guest should this become necessary. 9. Bathroom / Septic System The cottages and the log home operate on septic systems. The septic system is a very sensitive, and integral, part of cottage life. The basic rule is do not put anything down the toilet other than natural waste and toilet paper (and be conservative with the paper). It is critical that nothing else be flushed down the toilet, especially baby wipes or wet wipes (even if they say flushable on the packaging), feminine products, paper towel etc.. 10. Noise & Other Nuisances Pineridge Cottages limited seeks to provide and enjoyable vacation for all its guests. Noise should be kept to a minimum between 11:00 pm and 9:00 am. Should The Lead Guest or a member of their Rental Group create a nuisance for other guests, staff, pets or wildlife, the Lead Guest will be informed of the issue and given an opportunity to address and correct it. Should the problem continue to occur, the Lead Guest and/or a member(s) of their Rental Group will be required to leave. Pineridge Cottages has a zero-tolerance policy when it come to aggressive, threatening or bigoted comments made to staff or other guests. The offending individual and their party will forfeit their reservation and all payments and will be required to leave the premises immediately. Any situation involving the need to contact local law authorities will result in the guest being required to vacate the premises immediately No refunds will be given in these situations. 11. Use of Internet Services Where internet services are provided, guests are asks to be respectful of common spaces and to use headphones and be mindful of what they are watching that may be seen by others – in particular children. Pets 11.1 Typically, 1 dog per cottage is permitted. At times, Pineridge Cottages Ltd may permit two small dogs. Cats are not permitted without prior approval. No pets are permitted in The Log Home. 11.2 Where a pet is permitted, all evidence of its occupation must be removed from the property and grounds at the end of the rental period or an additional cleaning fee may be applied. 11.3 Pets are not permitted on any item of furniture, including beds, and evidence of pet hair on furniture may incur an additional charge of up to $500, plus additional cleaning charges. 11.4 Dogs may not be left in a cottage unattended or be unattended on the property at any time. Dogs must be on a leash or tether while at the cottage and/or under the control of an adult who is within an arm’s reach at all times. Dogs must remain within the property boundaries. Dogs may accompany their families to the main beach but guests are asked to keep their dogs off the sandy beach and on the grassy areas beyond the beach. Guests will be notified once if their dog is creating a nuisance. Should it be necessary to speak to the guest a second time, guests will be asked to remove the dog from the premises immediately. No refunds will be provided in this circumstance. 11.5 Pineridge Cottages Limited will not be held responsible for any pet-related bylaw fines. 11.6 Pineridge Cottages Limited accepts no responsibility for any allergic reaction or other conditions arising at any property, whether designated “No Pets” or not. The designation of “No Pets” does not indicate there have not been pets at the property at some time. 12. Smoking / Vaping Smoking and/or vaping of either tobacco, cannabis or any other substance is not permitted in any cottage or the Log Home. Any smoking that takes place in a Cottage will result in a charge of up to $500, plus additional cleaning fees. In the Log Home, a charge of up to $750, plus additional cleaning fees applies. Smoking and vaping are also not permitted on the beach. They are, however, permitted outside, away from open widows and doors. Receptacles for cigarette butts are provided. Clean up of cigarette butts around the cabin (i.e. left on the ground) will result in a $60 clean-up fee. 13. Fireworks & Campfires 13.1 Use of fireworks is not permitted within the boundaries of any cottage property. Failure to comply with this may result in eviction without refund and additional fees of up to $500, plus any additional damage incurred through bylaw fines. 13.2 Use of a campfire is only permitted in designated fire pit. Fires are not to be left unattended and must be attended by an individual with appropriate skill level and knowledge to manage the fire safely and appropriately. 13.3 The Guest agrees to comply with local fire restrictions that are posted in the vicinity and not to light any campfire during fire bans. It is the Lead Guest’s responsibility to determine whether or not a fire ban is in place at the time of their stay. 13.4 The forested grounds at Pineridge Cottages are protected. As such, outside wood is not permitted. The Lead Guest may purchase wood from Pineridge Cottages Limited for campfires. Those caught using outside wood will be required to leave the premises. No refund shall be given. 14. Equipment and facilities Advertised equipment and facilities are provided at the discretion of Pineridge Cottages Limited and while every attempt is made to ensure that such equipment is in working order for the duration of the rental period, should a breakdown or some other situation occur that renders an element unusable, Pineridge Cottages Limited will make efforts to replace the equipment or, in the situation of the “little extras”, the guest will be refunded a pro-rated amount for the defective equipment. The equipment and facilities referred to include (but are not exclusive to) such items as watercraft, motors, barbeques, refrigerators, cooking ranges and microwaves. 14.1 The Guest must report any inoperative or defective equipment to Pineridge Cottages Limited promptly. 14.2 Pineridge Cottages Limited will make every reasonable effort to have repairs made as soon as possible; however, there are limited service contractors in Cottage Country areas. While every attempt will be made to ensure that all the advertised equipment and appliances are in working order at the commencement of a rental period, no reduction of rent; rebate; or refund will be issued for a mechanical failure of TV, DVD or other non-essential appliances. 15. Refunds If a breakdown should occur to fundamental elements such as water systems, plumbing and electrical systems, and major appliances such as stove or refrigerator, every effort will be made to repair or replace. 15.1 If the amenity cannot be replaced or restored to reasonable use within 12 business hours, an appropriate refund may be made, at the discretion of Pineridge Cottages Limited. This does not apply to system breakdown caused by misuse, such as plumbing blockages caused by inappropriate use of sanitary facilities. 15.2 Pineridge Cottages Limited is not liable, nor will provide a refund, for any stoppage of electrical services caused by extreme weather or other circumstances beyond his control or any failure of public utilities. 15.3 There will be no refunds for naturally induced changes including (but not exclusive to) changes in water levels, fallen trees, road washouts etc., nor will conditions at neighbouring cottages, or any nuisance afforded by the natural elements of Cottage Country living such as insects or the animal population be cause for refund or rebate. 15.4 Pineridge Cottages Limited shall not be responsible for interruptions that may impede guests’ cottage rental experience, such as, but not limited to: construction noise, inclement weather, hydro outages, theft, allergies, noise violations and traffic during the rental period. 15.5 Where a refund may be agreed upon, the amount of refund shall in no case exceed the amount paid in rental fees. 15.6 If the rental cottage has been damaged by unforeseen circumstances, such as fire or flood, or acts of nature, and has been deemed “not rentable”, Pineridge Cottages Limited will make every effort to accommodate the guest in another cabin for the rental period provided that one is available. In the event that another cottage is unavailable for the period, the agreement shall become null and void and all payments will be refunded to the Lead Guest. 16. Other Conditions of Booking The Lead Guest and their Rental Group shall abide by these Terms and Conditions of Rental and any other instructions and/or any additional information supplied regarding the property, their stay or use of equipment given by Pineridge Cottages Limited. LIMITATIONS OF LIABILITY: The Lead Guest represents, warrants, acknowledges and agrees with Pineridge Cottages Limited that he/she/they, their pet and Rental Group will use the Property and its facilities in accordance with The Terms and Conditions above and the Cottage Information provided and that he/she/they does/do so at his/her/their own risk and that he/she/they indemnify/indemnifies and saves/save Pineridge Cottages Limited harmless from any personal injury, sickness or death, loss, theft or damage, however caused, to person or property of the Lead Guest, Rental Group, his/her family, pets or guests, before during or after the time of occupancy. Further, he/she/they accept(s) full responsibility for the use of the Property and any recreational equipment such as boats and motors, etc. and agree to pay for any damage of said equipment, other than for normal wear and tear. The Lead Guest further acknowledges he/she/they is/are responsible for ensuring they and all members of their Rental Group are observing all Boating and Fishing Regulations, including having required safety equipment in the watercraft, as well as meeting current Operator Competency Requirements and having appropriate license requirements.
The Lead Guest on behalf of their Rental Group: i. Agrees to read, understand and adhere to the Terms and Conditions outlined in this Vacation Rental Agreement provided by Pineridge Cottages Limited. ii. Agrees to accept all potential risks associated with a cottage rental, including, but not limited to: slips, trips, falls; indoor and outdoor activities; native insects and wildlife, recreational equipment operation, or any other risks not stated, are the sole responsibility of the Guest. iii. Agrees to take precautionary measures to reduce risks and prevent accident, injury or property damage. iv. Agrees to abide by any reasonable household rules posted at the cottage. v. Agrees to ensure all members of their Rental Group to be familiar with all Terms and Conditions pertaining to the rental By continuing with this booking via email, the Guest understands and agrees that they are entering into a legal binding agreement as per the authority Ontario Electronic Commerce Act, RSO 2000.
