Let's Do Mexico Vacation Rental Agreement
Las Olas Units #B-501, #B-504 and #B-505
San Jose del Cabo, Mexico
This Vacation Rental Agreement (the “Agreement”) is made by and between Homeowner/Let’s Do Mexico (“Homeowner/Agent”) and individual named on the reservation (“Guest”) as of the date set forth on the date the booking was made. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
The property is located at: México 1 Km 28, Tourist Corridor, Costa Azul, San José del Cabo, B.C.S.
The property is furnished and includes all furnishings and amenities provided within the unit. Entire unit has been photographed for condition and inventory purposes. Please see the Inventory Checklist attached as "Exhibit A".
The maximum number of guests is limited to four (4) persons in B-501, two (2) persons in B-504 and six (6) persons in B-505.
Term of the Rental:
The rental begins at 3:00pm on first day of your reservation (the “Check-in Date”) and ends at 11:00am on the last day of your reservation (the “Check-out Date”). Reservation dates are the dates you chose within the Reservation Key system.
Guest agrees to abide by the HOA Rules attached as "Exhibit B" at all times while at the property, and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while on the property. Any breaking of these rules may lead to a fine and Guest is responsible to pay the full amount.
One (1) vehicle is permitted per condo and vehicle must be parked in designated parking spot. Any illegally parked cars are subject to towing - applicable fines/towing fees are the sole responsibility of the Guest/vehicle owner.
While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. However, it is available upon request at an additional rate. We do not permit bath towels or linens to be taken from the unit, but we provide beach towels, which can be used while visiting the pool or beach.
Smoking is NOT allowed inside property at any time. Smoking is allowed outside only. It is Homeowners preference that no smoking occurs on the balcony of the unit, but rather on the grounds away from the condo. If any smoking does take place on the balcony, Guest agrees to ensure the sliding doors are completely closed until smoking materials are completely extinguished.
Maintenance and Repair:
The Guest shall maintain the property in good, clean condition and use the premise in only a careful and lawful manner. The Guest shall leave the premise in a well-maintained condition at the expiration of the rental agreement, defined by the landlord as being habitable for future guests. Guest will pay for maintenance and repairs should the premise be left in a lesser condition. The Guest agrees that the landlord shall deduct costs of said services from the security deposit prior to refund if Guest causes damage to the premises or its furnishings.
Guest is responsible for any missing or damaged item(s) in the condo. If anything is damaged, stolen or misplaced, Homeowner will bill Guest for the cost of the item, plus the cost of the shipping fee (28% the cost of the item) and a $25.00 service charge to cover all additional expenses.
Guest shall allow Homeowner access to the property for purposes of repair and inspections. Homeowner shall exercise this right of access in a reasonable manner.
Any garbage must be stowed in the proper garbage or recycling receptacle, which are located in the parking lot near the fence. Tenants are cautioned to not leave trash out as it attracts bugs and animals into the condo.
Water and Plumbing:
Guest shall not put ANY foreign item(s) (e.g., tampons, napkins, hair, gum, etc.) except toilet paper in toilet. Guest shall not allow any foreign matter down the drains (e.g., hair, food, etc.). If it is found that foreign objects have been flushed and clog the system, Guest will be charged for the repairs.
We highly recommend that Guest purchases travel insurance and that insurance is purchased as early as possible when making vacation plans. In instances of Acts of God (e.g. hurricane, tropical storm, earthquake, tsunami, Covid-19, etc.), our cancellation policy will be followed and Guest will need to plan on Travel Insurance Coverage for reimbursement. Early Check-in / Late Check-out
Check-in time is any time after 3 pm and check-out time is at 11 am. For early check-ins or late check-outs, there will be a $50 fee if there is availability.
Rental Rate and Fees:
Guest may choose to pay a refundable $500.00 damage deposit OR a non-refundable $99.00 damage waiver, due at the time of booking. Choosing either the damage deposit or damage waiver is mandatory to confirm booking.
The $500 security deposit will be collected to cover any damage to the property including but not limited to: (a) Additional cleaning charges above normal wear and tear, (b) damages resulting from intentional, willful or reckless conduct, (c) evidence of or damages by smoking, (d) items at property lost or stolen by Guest., (e) Any other cost (not previously agreed upon) incurred by Homeowner due to Guest’s stay. Any charges assessed for damages shall be deducted from the Security Deposit. Any charges above the coverage of the Security Deposit shall be the responsibility of Guest. If no damages are incurred the Security Deposit will be reimbursed within 3-7 business days after departure.
The $99 damage waiver covers up to $5,000 worth of damages. Fire damage is not included in the coverage.
Damage and Cleaning Issues:
Any damage or cleaning issues noticed upon arrival should be reported immediately. If damage or cleaning issues are not reported within 3 hours of your arrival, your credit card may be charged for the cost of the repair. All general maintenance issues should also be reported so the unit can be kept in good repair. You will not incur any additional charges if the following items are adhered to:
-No damage is done to the unit or its content including the linens.
-No items are missing upon the inventory check. (This includes, but is not limited to, transferring items to other units).
-All debris, garbage and discards are placed in proper containers.
-All soiled dishes are placed in the dishwasher.
-There was no exceeding the maximum occupancy of the unit.
-There was no smoking or evidence of smoking in a designated non-smoking unit.
-Unit is left in neat condition.
If you experience any problems whatsoever with the vacation property during your stay, please contact us and we will do our best to rectify the matter as soon as it is practically possible. Should a problem remain unresolved, you are required to notify us in writing within 7 days of your return. No action can be taken or liability accepted for any complaints received after this period. We aim to resolve complaints within a two month period from receipt, the details of which will be kept confidential to only the parties involved. Please note that as Los Cabos is a tropical State, insects such as ants and the like are occasionally inevitable, and are not cause for complaint. The vacation property is treated periodically as part of a pest and termite control program, and is cleaned after each rental.
Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in.
Guest assures us that the tenants will observe all conditions and terms of this agreement as to maintaining the rental in good order and appearance and will conduct themselves in a manner inoffensive to neighbors.
Guest assures that any tenant who violates any of the terms of this Agreement shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant’s guest(s).
Guest agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.
Guest and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance on or about the premises.
Guest agrees that during the term of this agreement and such further time as he/she occupies the premises, he/she will keep the rental clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the agreement, reasonable wear and tear and damage by unavoidable fire and casualty only exception.
Guest agrees to indemnify and save our company harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the premises by the Guest, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the premises.
We accept no responsibility or liability for any loss or damage or alteration to the terms of your reservation caused by events beyond our control, including but not restricted to war, terrorist activity, civil commotion, flight delays, or cancellations, airport closures, loss of luggage, adverse weather conditions, fire flood, or industrial dispute. We cannot accept any liability for failure of public supplies such as water, electricity, Internet or breakdown of the air conditioning system. Nor for the consequences of the action or omissions of persons who may control or supply main services, or any actions taken in the vicinity of the property reserved, by any authority over which there is no control.
We cannot accept any liability for your personal safety during your vacation. It is particularly important that children are supervised at all times in and outside the vacation property. We assume no responsibility for accidents. You are reminded to exercise care as to your personal safety, and the safety of your companions. Whenever possible, valuables should be left secure and out of sight.
We do not refund payments or deposits lost due to canceled or shortened stays because of weather. Departures due to inclement weather do not warrant refund of rent or deposit. We suggest Travel Insurance during the hurricane seasons.
Let's Do Mexico follows a strict cancellation policy.
Guests who cancel at least 60 days before check-in will get back 100% of the amount they paid.
Guests who cancel at least 30 days before check-in will get back 50% of the amount they paid. (31-59 days before check-in receives 50% refund).
No refunds for cancellations made within 29 days of check-in.
Please note that the same cancellation rate stands if you purchase transportation. 100% refund if you cancel 60 days before check-in. 50% refund if you cancel 30 days before check-in. No refund for cancellations made within 29 days of check-in.
Exhibit A - Inventory Agreement
Below is our inventory checklist that is checked before and after every stay in our condo. We kindly ask that you are mindful of these belongings. Do not hesitate to let us know if you find something damaged or missing within the first 24 hours of your stay. We understand that accidents happen and only ask that you let us know right away if anything was damaged or needs to be replaced so that we can have it ready for future guests.
Guest is responsible for any missing or damaged item(s) in the condo. If anything is damaged, stolen or misplaced, Homeowner will bill Guest for the cost of the item, plus the cost of the shipping fee (28% the cost of the item) and a $25.00 service charge to cover all additional expenses. Please maintain the following items:

Exhibit B - HOA Rules
To ensure that all residents enjoy their stay at Las Olas, the Homeowners Association asks that everyone read and comply with the following:
1. When you arrive, please register at the security gate so that security will know that you are an authorized resident.
2. While cars are parked, they must be kept locked for their own security and may not be stationary for more than 7 days. All vehicles must keep proper identification visible (unregistered vehicles may be removed).
3. Each unit has limited occupancy depending on the size of the unit. No more than 2 people in a one bedroom, no more than 4 people in a double bedroom and no more than 6 people in a three bedroom apartment.
4. Water and electricity are both in short supply and expensive, please conserve both.
5. No storage on patios. Patios should be kept clean at all times.
6. Laundry, bedding, rugs, towels, swimwear, etc., must not be hung from the balcony rails or visible clotheslines.
7. No pets are allowed by renters or guests.
8. Ground floor units are not to leave any personal items outside of their patio area.
9. Quiet hours are between 10:00pm through 8:00am.
10. The amenities are for the use of the owners, renters and their guests (guests must be with a renter or owner at all times) only.
11. The gym is for adults exercise only. Please turn the air conditioner off when finished.
12. Tennis court by reservation. Limit of one hour play if people are waiting.
13. Parking - one vehicle is permitted per condo. Please park within lines.
14. Comply with rules posted at pool and hot tub. Children must be kept under control and supervised. Children under 13 years old are not permitted in the hot tub.
15. Please don’t take dishes or glassware out of the condo - use the plastic cups provided.
16. All party’s or events must have prior written approval from the manager.
17. There is a limit of 2 guests per condo. More than 2 guests will need prior approval from the manager.
18. Do not leave your surfboard on the grass. All surfboard and personal items must be stored inside condos, condos decks or in lockers.
19. Use your access card or enter the code to get in the property, do not jump the wall.
20. Please put garbage in a closed plastic bag and deposit it in the designated area at the parking lot. Help us recycle.
21. Do not leave food exposed, as it could attract insects.
22. Lock all doors when you are out and at night.
23. Drones are not allowed in the property.
Construction time at Las Olas Condominiums is between August 1-October 15. If you are booking in these months, please be mindful that there may be loud noise between 9am-4pm for all units in both buildings. Please note that the HOA can schedule emergency construction projects at any time of the year, which is out of our hands. We will do our best to inform you as soon as we are informed of any projects.
