Rental Agreement and Rules for stay
This Short-Term Rental Agreement is made by and between Gracie Creek LLC and “Guest” as of the date last set forth in your online booking. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
1. Property: The property is located at:
83467 Gracie Creek Ave. Burwell, NE 68823
The property is furnished and includes a refrigerator, stove, oven, microwave, and dishwasher. It also includes miscellaneous items like: towels, linens, kitchen utensils and cookware.
2. Term of the Lease: The lease begins at 3:00 p.m. on the date of your arrival (4:00 pm on stays that start on Sunday) and ends at 11:00 a.m. on the morning after your final night’s stay.
Rental Rules
A. Respect the serenity of the area and the neighboring properties. Keep noise to a minimum.
- ATV activity is highly discouraged and illegal on all roads around the Calamus Lake, including gravel roads. The Gracie Creek property is only 4 acres so is not very suitable for ATV activity.
B. Smoking is allowed outside only. Take ALL precautions to prevent prairie fires.
C. Fires are ONLY to be burned in the outdoor fire pit. Take all caution in dowsing the fire at the conclusion.
a. Some seasons are not appropriate for any open flames. You will be notified of this concern.
D. Any other person in the property is the sole responsibility of Guest.
E. Gracie Creek LLC is not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
F. Keep the property and all furnishings in good order and in the places they were to begin your stay.
G. Only use appliances for their intended uses.
H. Pets are absolutely not allowed in Gracie Creek Cabin. Pets should remain outdoors and should be contained at night. If a pet is going to be contained on property, you must indicate this intention to the owners. Failure to do so may result in loss of deposit.
I. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We suggest you bring beach towels. We do not permit towels or linens to be taken from the unit.
J. Please remove bedding from those beds that were used. This will help to conserve regarding beds that were not in use.
K. Remove only sheets and pillow cases for laundry. Quilts, mattress pads, and blankets should not be thrown in the laundry unless completely necessary (spills, illness, etc)
L. The Grace Creek Cabin is on a well and septic system. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that feminine products have been flushed and clog the septic system, you could be charged damages of up to the value of replacement.
3. Minimum Stay: This property requires a 2-night minimum stay. Longer minimum stays may be required during holiday periods, summer months, or weekends. If a rental is taken for less than 2 days, the guest will be charged the 2-night rate.
4. Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.
5. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.
6. Rental Rate and Fees
a. The Gracie Creek Cabin comfortably accommodates 15. Extra guests beyond 15, will incur an extra $3 per night to cover additional expenses for upkeep and supplies.
b. Down payment: A down payment of $250 is due at the time of making a reservation to hold the date.
The down payment is for securing the dates of rental and will be applied toward the value of your stay.
The credit card used for your reservation will be kept on file and used additionally to recover loss or damage as noted below:
i. damage or loss of property to the property or furnishings;
ii. dirt or other mess requiring excessive cleaning; or
iii. failure to follow the “check out” routine as provided by the Homeowner
iv. any other cost incurred by Homeowner due to Guest’s stay.
If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately.
Cancellation Policy
Cancellation Policy: If Guest wishes to cancel his/her reservation:
A) at 61+ days prior to check-in date, Total Due is not billed. Deposit is not refunded.
B) at 31-60 days prior to check-in date (Total Due was billed at 60 days). Half of Total Due will be refunded back.
C) at 1-30 days prior to check-in date, No refund will be made on the Total Due amount.
