SHORT-TERM LEASE AGREEMENT
(Saskatchewan)
This short-term lease agreement (hereinafter "Agreement") is in contract for the dates booked and confirmed upon. This agreement is and hereinafter is between:
Craig and Chara Blair, having an address at the following:
Box 187 McLean, Sask. S0G 3E0 (hereinafter referred to as the "Lessor" and or “host”) and
You the person booking and agreeing to the rental dates will be (hereinafter referred to as the "Guest")
(the Lessor and the Guest are hereinafter referred to as the "Parties")
The Parties hereby agree as follows:
1. GRANT OF LEASE
The Lessor hereby leases unto the Guest, and the Guest hereby rents from the Lessor, the real property located at the following address:
807 Sioux Avenue Fort Qu’Appelle Sask. Canada S0G 1S0
(hereinafter referred to as the "Property").
The property is furnished and includes the following: All contents videoed and logged on the property as per rental date.
2. TERM. This Agreement will begin on (the "Check-In Date") and end on (the "Check-Out Date"). The time period between the Check-In Date to the Check-Out date will hereinafter be
referred to as the "Term".
The Guest must vacate the Property by the Check-Out Date, unless the Lessor and the Guest both agree in writing to extend the Term of the Guest's rental of the Property.
3. RENTAL RULES
The Guest agrees to abide by the following rental rules at all times during the Guest's stay at the Property:
A list will be sent to you in the Welcome book link prior to check in as well as a hard copy will be available in the property. The Guest shall also ensure that any person Guest permits on the Property will also abide by the rental rules.
4. RENTAL RATES & FEES
a) A security deposit of the following amount is required: $500.00 and was required and confirmed to ensure booking reservation.
b) Provided there are no necessary deductions made due to damage to the property or furnishings, excessive dirt or any other mess requiring extra cleaning, or any other cost incurred by the Lessor due to the Guest's
stay, the security deposit will be refunded within the following amount of time after the Check-Out Date: 3 business days. If substantial damage exceeding the amount of the damage deposit occurs the Guest will be expected to cover all charges owing to fix,repair or replace all damages at owners discretion. If such deductions are necessary, the Lessor will send Guest an itemized list, describing the charges, and return any security deposit amount leftover, if any amount is leftover.
c) The Guest shall pay the rental fee as determined and confirmed by either Airbnb/ Vrbo or direct booking from freshevue.ca or any websites. The Guest will also be responsible for the following additional fees:
A cleaning fee is included in the rental agreement totalling $300.00 If additional cleaning is needed that will be deducted from the damage deposit.
d) The cancellation policy is as follows: Full refund for cancellations made within 48hrs of booking. If the checkin date is at least 14 days away a 50% refund. For cancellations made 7 days or less before checkin No refund will be provided. ( DAMAGE DEPOSIT WILL BE FULLY REFUNDED NO MATTER THE TIMEFRAME OF CANCELLATION). Due to Covid 19 we have the following cancellation policy in place : Full refund 1 day prior to check in . This policy is only in place for Covid Restriction protocols and may only be used for that reason.
5. INSURANCE
The Lessor is not liable to the Guest or any of the Guest's invitees, licensees, and/or guests for any damages not proximately caused by the Lessor and the Lessor will not compensate the Guest or any other person for damages proximately caused by any other source, including acts of God and nature. The Guest is therefore required to purchase insurance to protect the Guest, the Guest's personal property and any person on the Property. If the guest chooses not to purchase insurance it is not the responsibility of the Lessor and therefore Guests and anyone on the property enter such at their own risk and therefore are not the responsibility of the Lessor.
6. TERMINATION Should the Guest violate any of the terms of this Agreement, the Lessor may terminate the Parties' relationship and this Agreement immediately and without notice. The Guest waives any and all rights under this Agreement upon any violation or breach. The Guest shall vacate the Property immediately upon the Lessor's request. If the Lessor finds any damage to the Property, which amounts to a monetary cost of more than any given security deposit or rental fees, the Lessor may seek all legal avenues for recovery.
7. MAINTENANCE & REPAIR
The Guest shall maintain the Property in a good and clean manner and use the premises lawfully. Guest shall leave the Property the way Guest found it at the beginning of this Agreement. If Guest has left the Property in any way that requires additional maintenance and/or repairs, Guest hereby agrees to pay for such maintenance or repairs. Additionally, Guest agrees that if there is any delay in everyday maintenance or repairs for reasons beyond Lessor's control during the term of this Agreement, this shall have no effect on Guest's obligations under this lease.
8. ADDITIONAL GUESTS
The Guest may have additional overnight visitors to the Property, but with prior permission from the Lessor is required.
9. PERMITTED USES
The Property shall be used and occupied solely as a cottage getaway. If the guest requires it to be used as something else agreement must be confirmed and agreed upon with the Lessor.
10. PET POLICY
Any and all pets or companion animals, with the exception of service animals as dictated by applicable provincial, territorial and federal law, are prohibited under the terms of this Agreement.
11. SMOKING
The smoking policy for the Property is as follows: Smoking is only allowed outside and all butts are to be disposed of properly in the designated area and not left on the grounds of the property. Under no circumstances is there to be smoking or vaping in the house or on its outdoor living areas. We request that any and all smoking /vaping be done on the driveway area only and all butts be disposed of properly. Absolutely NO Illegal substances are to be used or brought on to the property.
12. TRASH
The Guest shall dispose of trash in the following place and manner:
Trash should be placed in trash bags and put in the proper bin outside at the street entry. please refer to the Welcome Book for additional house info.for further instruction.
13. USE OF PROPERTY
This Agreement is only for transient occupancy of the Property, and the Guest may not make the Property a residence or permanent household.
14. FIREARMS
Guest shall not have any firearms or other flammable or hazardous materials on the property, such as fireworks.
15. ILLEGAL USE
The Guest shall not use the Property for any illegal purpose, including but not limited to illegal drug use, harbouring a fugitive, prostitution, or abuse of any person or animal. If Guest is found to be engaging in any illegal activities on the Property, this shall be cause for immediate termination of this Agreement.

16. FIRE ALARMS
If the guest notices any deficient activity, such as beeping, from any fire alarm on the property, the guest shall notify Lessor immediately. Otherwise, the guest shall not tamper with any fire alarms or smoke detectors on the property.
17. INTERNET
Access to the Internet has been provided in the Property as a courtesy and convenience for the Guest. The Guest hereby acknowledges and agrees that internet access is not integral to this Agreement. No refund of any payment or fee will be given in case of Internet outages, speed, or access problems.
18. COOKING
The Guest may only cook in the areas that are designated as such, such as a specific kitchen area.
19. LOCKS
The Guest may not alter or replace any locks on the Property .The Guest may also not add any new locks on the Property.
20. HAZARDOUSMATERIALS
The Guest agrees not to keep any hazardous item on the Property, whether chemically dangerous or otherwise lethal or that might be considered hazardous by any legitimate insurance company.
21. UTILITIES
The Lessor is responsible for arranging and paying for all utilities.
22. QUIETENJOYMENT
The Lessor may not interfere with the Guest's peaceful use and quiet enjoyment of the Property.
23. HABITABILITY
The Property will be made available in a condition permitting habitation, with reasonable safety.
24. ALTERATIONS & IMPROVEMENTS
The Guest shall not make any alterations, additions or improvements or do any type of construction to the Property.
25. ASSIGNMENT & SUBLET
The Guest is not permitted to assign or sublet this Agreement without the prior written consent of Lessor. The Guest may also not grant any license to use the Property or any part of it.
26. INDEMNIFICATION
The Lessor is not liable for any damage or injury to Guest or Guest's invitees, licensees or other guests on or in the property and the Guest hereby agrees to indemnify and hold the Lessor Harmless from any and all claims or assert actions of every kind of nature.
27. MODIFICATION
No modification of this Agreement shall be binding upon Lessor unless in writing and signed by Lessor. Modification to any part or sub-part of this Agreement shall have no effect on any other part or sub-part of this Agreement and the remainder of the Agreement shall remain in full force and effect.
28. ITEMS LEFT BEHIND
Any items left behind by Guest will be held for approximatly 7 days and every reasonable effort will be made to contact Guest for their return. However, ultimately Lessor is not responsible for these items. If they are not claimed within 7 days, Guest forfeits Guest's right to such items and Lessor shall not be held responsible for any disposal.
29. SEVERABILITY
If any part of sub-part of this agreement is deemed invalid by court order, judgment or other operation of law, the remaining parts and sub-parts of this agreement shall remain valid and enforceable to the fullest extent.
30. NO WAIVER
If Lessor fails to enforce strict performance of any part or sub-part of this Agreement, this shall not be construed as a waiver of Lessor's right to enforce the same part or sub-part later in time or to enforce any other part or sub-part.
31. GOVERNINGLAW
This Agreement will be governed by and construed exclusively in accordance with the laws of the province of Saskatchewan, and the laws of Canada in effect in Saskatchewan. For litigation arising from this Agreement, the parties submit to the exclusive jurisdiction of the courts of Saskatchewan, and to any other court having jurisdiction over the party solely to enforce a judgment of a court of Saskatchewan. Neither party may seek to enforce an order that has its origin in any court other than the courts of Saskatchewan.
35. NOTICES
Notices given under this Agreement or other applicable law will be given in writing. Notices by the Guest to Lessor will not be considered complete until actual receipt by Lessor at the address listed at the head of this Agreement. The Lessor or Lessor's agents, including any property managers, secretaries, or assistants, shall accept demands and/or service of process at the same address. Notices by the Lessor to the Guest shall be deemed delivered when deposited in the mail to the address of the Property or hand-delivered or placed in the mailbox of the Guest at the Property. Notices by the Lessor to the Guest will be deemed delivered if addressed to a last known post office box address of Guest.
37. COUNTERPARTS
This Agreement may be executed in counterparts, all of which will constitute a single agreement.
38. A hot tub is located on the property and guests may use under the rules provided in the virtual welcome book. The host/Lessor is not responsible for anyone using the hot tub and the guests and anyone the guest permits on the property does so at their own risk. If upon check out we (host) determine the hot tub to be in misused condition and requires extra cleaning a fee of $200 will be charged to the guest/lessee .
SIGNATURES. A hard copy of this agreement can be printed off and signed upon check in date but this agreement is bound and legal once the guest confirms the booking by making the reservation on Airbnb or Vrbo or our own direct booking . Once your booking is confirmed the rental agreement is therefore after agreed upon and legally
bound by both the Lessor and the guest.
